1. General Provisions

1.1. These Terms and Conditions ("Terms") apply to all individual and corporate users ("User") who use the Emporta platform ("Platform"). Emporta is operated by Mycomp IT-Services GmbH ("Mycomp"), Im Bielacker 13, 8580 Amriswil, Switzerland (Registration number: CH-440.4.024.289-6, VAT number: CHE-115.868.226). By using the Platform, you are deemed to have accepted these Terms.

1.2. Emporta reserves the right to modify these Terms without prior notice. Updated terms shall take effect from the date of publication on the Platform.

1.3. The Platform may only be used by individuals who are at least 18 years of age and legally capable of entering into binding agreements.

2. Account and Security

2.1. Users are responsible for providing accurate and up-to-date information when creating an account. Providing false or incomplete information may result in account suspension.

2.2. Account security is the User's responsibility. You must not share your password with third parties and must immediately notify Emporta upon detecting any unauthorized access.

2.3. Emporta reserves the right to temporarily or permanently suspend any account in the event of a suspected security breach.

3. Use of Services

3.1. All services offered through the Platform may only be used for lawful and legitimate purposes. Users agree not to use the Platform for any illegal activity.

3.2. Users do not have the right to copy, reproduce, distribute, or commercially exploit any content on the Platform; such actions constitute copyright infringement.

3.3. Emporta does not guarantee that services will be uninterrupted or error-free. Service interruptions may occur due to maintenance, updates, or technical issues.

4. Privacy and Data Protection

4.1. Users' personal data is processed in accordance with applicable data protection laws and regulations. Please refer to our Privacy Policy for detailed information.

4.2. Emporta may share user data with third parties only for legal obligations or for the purpose of delivering services.

4.3. Users may exercise their rights of access, rectification, and deletion of personal data at any time.

5. Intellectual Property Rights

5.1. All content, designs, logos, software, and other intellectual property on the Platform belong to Emporta and are protected by copyright laws.

5.2. While Users retain the intellectual property rights to the content they create on the Platform, they are deemed to have granted Emporta a license to use such content for the purpose of delivering services.

6. Limitation of Liability

6.1. Emporta shall not be held liable for any direct or indirect damages arising from the use of the Platform. Users use the Platform at their own risk and responsibility.

6.2. Third-party services or links accessed through the Platform are beyond Emporta's control, and Emporta is not responsible for any issues arising from such services.

7. Termination

7.1. Users may close their accounts at any time. Account closure requests will be processed upon completion of any pending transactions.

7.2. Emporta reserves the right to suspend or permanently close the accounts of Users who violate these Terms without prior notice.

8. Governing Law and Dispute Resolution

8.1. These Terms are governed by the laws of the applicable jurisdiction. Any disputes arising from these Terms shall be resolved by the competent courts.

8.2. The parties agree to first attempt amicable resolution of any disputes.
